Gansz V. Alton Haunted House Essay

The case of Gansz V. Alton Haunted House originated when a girl tripped while running from an individual with a loud motor driven chainsaw at a haunted house in Alton, Illinois on October 29, 2011 (Faces of Lawsuit Abuse, 2013). The girl’s father, Terry Gansz, claims the haunted house tour included a section where patrons were directed through a passage leading to a ramp with an entry to the rear of the haunted bus. American Legion is being blamed for the design of the haunted house making it difficult for patrons to exit the attraction (Madison Record, 2013). Arguing that the plaintiff voluntarily assumed the risks of the haunted house, the defendants claim they are not at fault and should not be liable for any injuries claimed (Madison Record, 2013). Issue: Has negligence been demonstrated? Rule According to Cheeseman (2013), negligence is a â€Å"A doctrine that says a person is liable for harm that is the foreseeable consequence of his or her actions† (p.91). The elements of negligence include: Duty of Care Breach of Duty Harm Legal Causation The case of Gansz versus Alton Haunted House exemplifies the foundation of the fault principle. Terry Gansz the father of a young girl who was injured when she tripped over a ramp at the Haunted House alleges that there was failure to ensure the safety of the patrons who visited the haunted house.  Alton Haunted House had a duty to exercise reasonable care for those who would visit the haunted house. The unforeseen danger of the participants were not averted and the injuries suffered by the young girl is the fault of Alton Haunted House. Alton Haunted House believes the young girls harm was the result of her own negligence. It was not the duty of the young girl to research beforehand the possible dangers of the haunted house. Analysis In our analysis of the case team D recognized that there were flaws in the defendant’s case. The defendants had a responsibility, a duty in fact, to ensure the safety of the patrons. There should be a limit as to how far actors should be allowed to come to patrons. Also nowhere in the case did it state that a sign was posted stating enter at your own risk or anything of that nature. So team D concluded that the defendant must be held liable for their action because there were no clear policies in place for employees with regards to chasing patrons. . Duty of care is listed as â€Å"Duty of care is defined as the â€Å"obligation people owe each other – that is, the duty not to cause any unreasonable harm or risk of harm† (Cheeseman, 2013, p. 91). We believe that is was there duty to ensure safety. Conclusion Learning Team D reviewed the case of Gansz v. Alton Haunted House using the IRAC method. Based on the issue, rule, and analysis conducted, the team’s conclusion is that Alton Haunted House is liable for negligence because they breached their duty of care. This breach resulted in foreseeable injuries to the plaintiff. In this case, patrons did assume a level of risk by entering into the house; however, Alton Haunted House still had a responsibility to ensure their employees were properly trained and supervised prior to interacting with patrons in order to minimize the risk of injury. This case provides an excellent example of the liabilities business owners may encounter. Arthur Miller wrote the play Essay

What Miller does do to excellent effect is keep the pace of the plot speeding along and twisting in different directions all the time, at one time the focal point is on Danforth and his control of the court, then at another it is Abigail and the girls feigning that Mary Warren’s spirit has possessed them. Throughout this extract he keeps the dramatic effect by having many different plot lines run into each other at this point; Proctor’s attempt to save Elizabeth, Mary Warren’s declaration that the girls are putting on a show and Abigail Williams’ and the girls dramatic role-play claiming Mary Warren is sending her spirit out on them. All of these plot lines are intertwined in the court room scene and are exposed in John Proctor’s announcement that he is guilty of lechery. Some of the central themes and concerns in The Crucible are evident in this extract intolerance, being a society run strictly by a theocracy means that Salem is run by strict laws and religion. Any wavering outside these rules or religious thoughts is unacceptable. Danforth is intolerant when listening to Proctor and Giles Corey’s attempted reasoning and proposals. Salem at this time was intolerant of any un-natural endeavours, just as America in the 1950’s was intolerant of any un-American activities or communists. Acts of search and arrest became known as McCarthyism, led by Senator John McCarthy. Hanging those who were accused was seen as restoring purity to the theocracy in Salem. Another recurring theme in The Crucible is that of personal reputation. In this extract Proctor seeks to keep his name from being tarnished by giving testament against Abigail claiming that she is delivering her accusations through jealousy of his wife Elizabeth, and by announcing that he has committed adultery through his affair with Abigail. Reverend Parris acts only on what he thinks is best for his reputation throughout the whole play, particularly in this extract when he lies about seeing the girls naked dancing in the woods, â€Å"I do not deny they danced, but I never saw any of them naked†. Parris lies in order to keep his reputation, for if it were released that he had found his daughter and many other girls dancing naked in the woods and ‘compacting with the devil’ then he would be driven from his office as the reverend of Salem. Judges Danforth and Hathorne are both unwilling to accept that Proctor is innocent and do not want to admit to being deceived by a bunch of girls claiming witchcraft and are therefore forced to charge John Proctor to keep their own reputations, making the interrogation partial towards the young girls and unfair on Proctor. The other central theme of the play is the role that hysteria can play in societies. The lies by Abigail all the way through the play and particularly in this extract easily manipulate the judges and the residents of Salem to turn against the accused which ultimately leads to their executions. Miller has linked this hysterical theme to the McCarthyism period in which he lived in the 1950’s, the hysteria led by Senator Joseph McCarthy and his hunt for communists and communist sympathisers in post WWII America and during the Cold War. Miller seems to have based his character Judge Danforth on the individual Senator Joseph McCarthy: both are over-seeing the hysteria of the communities and are leading the search for the accused and presiding over their trials.

Jabez Wilson Jabex Wilson is a character in the story the red headed league he is the owner of a local pawnshop, he is given a false job in the story. The fake job he is given, although simple pays very good money, he takes the job and leaves his partner in charge of his pawn shop, him taking the job shows that, like anybody in Victorian England, he would do anything for money, he also took on his assistant , Vincent spaldling, because he offered to come at half wages. Vincent Spalding Vincent Spalding is the character of Wilsons assistant in the red headed league. He tricks Wilson into leaving him the shop so that he can dig to a nearby bank. He is actually john clay in disguise, john clay is a famous bank robber who is wanted by the police. he is very cunning with the way he works, he fixed a fake advertisement, fake job, fake identity all for one job, this in some ways shows that he has determination and devotion to what he does. The place of servants The place of servants throughout these stories, is not very obvious. in the speckled band the manor house in which Helen Stoner and Dr Roylott live, is said to have a room for the maid. this shows that housing was provided for servants. It shows that although there is a definite hierarchy between master and servant, considerations are made on the part of food, and housing. The role of women In the three stories which I studied the role of women varies, in the man with the twisted lip Mrs. St Clare comes across as the type of woman that stays in and cooks and cleans at her husbands demands, she has dinner for him at his arrival home in the evening and doesnt ask where his money comes from or what he does, she just accepts that it is money. Whereas is the speckled band Helen Stoner is much more independent of her self, she rides on the train and dog cart in the early hours of the morning without permission, she tries to find out for herself the cause of her sisters death and seeks out her own help even though she is fully aware of her stepfathers capabilities. The nature of Law and Order Compared to real Victorian England the police in the stories come across as very laid back, in the red headed league they are fully aware of the happenings and still offer to make all of it disappear even though it is a very large investigation, and is very important. Although the police are satisfactory to the community, Holmes always seems to outsmart them, as it were, always get there first. But yet he is not a part of the police service, he isnt running a private service for money because he only asks for the expenses to be paid. this shows his devotion to the service and how he doesnt do it for the money. Transport and communications The transport in the stories is quite modern in some parts, in the speckled band, Helen stoner uses a train to reach Holmes, this shows that train run at all hours, because she was traveling at early hours of the morning. She also used a dog cart or horse and carriage. Communication was not really mentioned in the stories but telephones are mentioned a few times, this shows more than telegram communication is used . Gender Inequalities in Health and Illness Gender Inequalities in Health and Illness This essay will look at the gender inequalities in health and illness statically. This essay will also look at how women live longer than men and what diseases and mental health symptoms affect both men and women in mortality and morbidity rates such as cancers and depression. Statistics will show how people are living longer and how this will continue as more people will become centenarians as the years go by. This essay will also show findings of stereotypes or stigmas attached to both genders and how this affects healthcare both physically and mentally along with how society thinks in regards to both genders and the impact this has. Finally it will look at masculinity and how and why this affects men going to the GPs about their healthcare and the effects of this. Today women tend to live longer than men on average in industrialised countries, although this is true women experience more ill health through their lifetimes compared to men. More women rather than men suffer from somatic complaints such as aches and pains, headaches and tiredness to mention a few (Backes, G et al, 2008). Women’s mortality rates are often because of breast, cervix and uterus cancers whereas ischemic heart disease and lung cancer has a higher mortality rate in men (Bury, M, 2005). Although some researchers believe there is more consistency in studies that involve depression, anxiety and minor psychological illness compared to the studies of higher illness rates in women (Bartley, 2004). At all ages males have a greater mortality rate than women in the United Kingdom due to injuries and suicide. Cardiovascular disease and cancers are also one of the main reasons male mortality rate is higher than that of women’s. Depressive disorder, mental health, anxi ety and disability all have higher morbidity rates for women than men (Acheson, 1998). Higher mortality rates in men can be explained by social factors such as employment whereby males tend to be in employment that is ‘risky’ such as exposure to toxic chemicals, environmental hazards and dangerous machinery. Driving under the influence of alcohol, dangerous sports and road traffic accidents are all major risk taking behaviours that men rather than women tend to participate in (Bury, M, 2005). Men used to have a higher smoking rate than women resulting in lung cancer but today it is seen that young girls under fifteen years of age are more likely to smoke than boys of the that same age group. The recommended daily intake of alcohol is usually acknowledged by women whereas men in all age groups tend to drink more than the recommended daily intake (Scambler, 2008). One third of babies born in 2013 will live to they are one hundred according to the office for national statistics. Of these 797,000 babies that were less than one in 2013 in the UK, 151,000 of these will be women and 123,000 will be men that live to one hundred in 2113 (Office for national Statistics, 2013).Whereas only 8% of men and 14% of women who were sixty-five in 2013 would go on to live until they are one hundred around 85,000 altogether. Looking further back in time there were only six hundred centenarians in 1961, ninety of these being men, this has increased every year since then for example in 2013 there were a total of 14,000 centenarians in the United Kingdom (Office for national Statistics, 2013). It is expected that 111,000 people will live to one hundred or more by 2037. Women are expected to become centenarians more so than men in all years as in 1961 there were five hundred this rose to 12,000 in 2013 and is expected to rise higher resulting in 77,000 women becomin g centenarians by 2037 and 293,000 by 2062. Men have had a rapid rise in centenarians from 1961 where there were only ninety centenarians this rose to 2,000 in 2013. It is estimated men living to one hundred or over will rise to 34,000 by 2037 and 163,000 by 2062 (Office for national Statistics, 2013). The latest figures from the Office for National Statistics show that in ‘good’ health men in the least deprived areas could live to 70.5 years whereas men in the most deprived areas could live to 52.2 years. Women on the other hand can live in ‘good’ health in the least deprived areas for up to 71.3 years whereas women in the most deprived areas can live to 52.4 years. When measured by the range there were nine years difference between men in the most deprived areas compared to the men in the least deprived areas (Office for National Statistics, 2015). Women when measured by the range had a 6.9 year shorter life expectancy for women in the most deprived areas compared to the women in the least deprived areas. In ‘good’ health men in the least deprived areas lived 19.1 years longer and 19.5 years for women (Bury, M, 2005). There are a lot of assumptions around gender stereotypes that are socially constructed which to this day still exist in society. People or society expect a women to be a certain way or act a certain way such as staying at home looking after children and being a housewife rather than getting a job and that they are responsible for raising children (Cook, R and Cusack, S, 2010). Women are nurses rather than doctors, women do not need to have a career, and women should cook and do housework. Women do not or cannot have technical jobs such as being a mechanic these are some of the stereotypes associated with women (Cook, R and Cusack, S, 2010). People or society expect a man to enjoy working on cars, are doctors and not nurses, that men do ‘dirty’ jobs such as construction or mechanics. Men do not do housework and are not responsible for taking care of children, men are in charge husbands tell their wives what to do and are lazy or messy these are just some of the stereotype s associated with men (Health Guidance, No date). These stereotypes can affect both genders mentally and physically and can have an impact on mortality and morbidity rates such as a man doing a ‘dangerous’ job or a women having depression. Masculinity ideology plays a vital role in men’s health, men believe they should be powerful, strong, brave, intelligent, healthy, mature and in control (Sabo, D and Gordon, F, 1995). When these statements are untrue or thought to be untrue it can have a negative impact on men resulting in substance misuse and criminality, depression and suicide to mention a few as a lot of men especially young men feel powerless, weak, fearful and do not pay attention to their mental, physical or emotional health (Key issues in promoting health, No date). It is a fact that women are more open to talk about health problems than men which is why women that suffer from depression and anxiety are seen to have higher morbidity rates according to statistics. It is thought that biological and social factors contribute to depression and are seen differently in both men and women (Mental Health Foundation, No date). Men aged sixteen to forty-four are less likely to visit GPs than women due to worries of losing pay from their job if they take an appointment but also from masculinity problems such as thinking the environment in GP surgeries are too feminine and the general attitude men take towards healthcare and social expectation when they are ill (Harvey, S, et al, No date). It is also seen that because women are more open about their health, statistics show they visit the GPs more often than men and that they may go to the GPs for less severe symptoms of illness compared to men (Harvey, S, et al, No date). In conclusion this essay has looked at the statistics of inequalities in health and illness. Such as the fact that today women tend to live longer in industrialized countries than men and it seems that it is going to continue in that way, at the same time there has been a rapid rise in men living longer with mortality rates decreasing due to different employment available in this present day. Women morbidity rates are higher than men’s due to women seeking medical advice more often and being more open about their healthcare issues, whereas men avoid GPs either because of worry of losing pay from work or masculinity reasons such as the stigma that ‘men do not get sick’ (Bartley, 2004; Acheson, 1998; Scambler, 2008; Harvey, S, et al, No date). Although life expectancy rates are higher for both men and women it also seems that people living to one hundred or more is on the rise from six hundred centenarians in the 1960s to fourteen thousand centenarians in 2013 and it is estimated to rise higher each year onwards. Stereotypes have also had an impact on both genders due to society having the thought that men should have ‘dirty’ or ‘dangerous’ jobs and women should stay at home or have ‘clean’ jobs therefore it can result in physical problems or higher mortality rates for men and mental health problems such as anxiety or depression for women. The Character of John in The Yellow Wallpaper  Ã‚         John's fascination with observing his wife can be attributed to a physician's distorted interest in the body. We can certainly speculate that, as physicians at the turn of the century were beginning to explore the female body assisted by "developments" in gynecology, John may have been equally interested in these new techniques of viewing the female body. More so than ever, the patient and her body became subject to the physician's privilege to intimately observe and diagnose her.   Ã‚  Ã‚  Ã‚  Ã‚  Ostensibly, the narrator's illness is not physiological, but mental. John concludes that his wife is well except for a "temporary nervous depression--a slight hysterical tendency," a diagnosis that is confirmed by the narrator's own physician-brother (Gilman 10). John's profession, and moreover his diagnosis, is a license to closely observe, scrutinize, watch, gaze upon, seek out, and investigate his wife and her ailments, which consequently permits him to deploy seemingly inexhaustible (medical, scientific) means for (re)formulating and (re)presenting the hysteric female--not only for the purpose of giving her discursive representation, but in order to "de-mystify" her mystery and reassure himself that she is, finally, calculable, harmless, and non-threatening. I Just Wanted to Write    For as long as I can remember, I've wanted to be a writer.   Whenever my elementary school teachers announced that we were going to write a fairy tale or a ghost story, I would nearly jump out of my chair with excitement.   Of course, writing days were few and far between - there weren't many seven-year-olds who would rather write a story than draw a pony--so I started writing at home.   I would pick up a pencil whenever an opportunity presented itself, finding inspiration in the most mundane things.   Of course, I never actually had the patience to finish a project at that age--by the time I was two stories into a book of fairy tales, I would abandon it for a book about unicorns or robot monsters.   I didn't care that I never finished anything.   I just wanted to write.      Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Eventually, those childhood stories began to change into more complex ideas.   Originally, the all-important factor had been writing in itself, but that changed after several years.   Th. most meaningful thing to me now is character.   I can be doing something that has nothing to do with writing (usually trying to fall asleep), and a character will walk into my head and bluntly demand to be written.   I don't feel as if I am an actual author, creating and populating my worlds.   I'm only a biographer, telling my characters' stories.   Although I still want to write for my own benefit, I feel an obligation to them as well.   They're like children to me, and their stories deserve to be told.   However, some things never change:   I still enjoy writing about fairies, monsters, and unicorns.   Most of the characters who walk into my head are wizards or elves.      Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   I've taken as many steps as possible to try and succeed in my goal.   I have little free time, but I spend as much as I can on writing.   I've filled the pages of four notebooks with potential plots, possible character names, and potential alien races or systems of magic--anything to make sure I don't forget an idea.   When I finished my first novel, I hunted down as many people as possible to proofread it, and I made sure to actually listen to their advice.   It isn't ready for publication yet, but that's fine with me--the changes they suggested, while difficult, will improve my chances of success.

Probably the most dangerous type of alcoholism, because they are most likely to die of alcohol poisoning. How do people become alcoholics? Alcoholics don’t know how they became alcoholics. Some say it is genetic on the stress gene, triggered by psychological or social stress. While others say it is a learned maladaptive coping behavior. Studies have shown that alcoholism may be genetic. If alcoholism is genetic it would be indirect. it would be related to the stress gene. This means that stress would set off a trigger that makes alcohol a want to the person. If alcoholism is learned behavior it means that drinking is a bad coping skill, most likely learned through an alcoholic parent. What are the effects of alcoholism, on both the alcoholic and their family? Alcohol has terrible effects on health, family and work. The effects of alcohol on the body are cirrhosis of the liver, loss of brain cells, stomach cancer, depression, tremors and blackouts. An alcoholic in the family causes many disruptions to the members of the family. They start argum ents and fights by not functioning or being drunk. They either do not attend family gatherings or disrupt them. Some alcoholics can be abusive to other family members. A lot of alcoholic families find themselves in financial trouble, caused by the alcoholic using most of the money to buy alcohol. Plant layout refers to the arrangement of physical facilities such as machines, equipment, tools, furniture etc. in such a manner so as to have quickest flow of material at the lowest cost and with the least amount of handling in processing the product from the receipt of raw material to the delivery of the final product.
